Apportionment of the rent charge in lieu of tithes in the township of Shirley

Whereas an agreement for the COMMUTATION of TITHES in the Township of Shirley in the parish of Shirley in the county of Derby was, on the twenty seventh day of February in the Year One Thousand Eight Hundred and Thirty Seven, confirmed by the Tithe Commissioners for England and Wales, of which Agreement, with the Schedule thereunto annexed, the following is a copy:—

Provisional Articles of Agreement for the Commutation of the tithes of the township of Shirley in the parish of Shirley in the county of Derby in pursuance of the Act for the Commutation of tithes in England and Wales made and executed at a meeting duly called and holden and adjourned from time to time and holden by adjournment at the Saracen's Head Public House in the said township on the thirteenth day of December in the Year of Our Lord One Thousand Eight Hundred and Thirty Six and since perfected according to the provisions of the said Act by and between the several Persons owners of land within the said township by whom ( or by where agents duly authorized in that behalf ) these presents are executed and the Interest of which Land owners in the lands of the said township is not less than two thirds of the lands therein subject to tithes of the one part and the interest of Revd Walter Augustus Shirley Clerk Vicar of the said parish of Shirley and Robert Steeple of Shirley aforesaid Farmer Owners of all the tithes as well great as small of the said township of Shirley of the other part

It is by these presents witnessed that at the said meeting it hath been and is mutually agreed upon by and between these presents in manner following that is to say

That the annual Sum of One Hundred and Fifty Three Pounds Seventeen Shillings and Six Pence by way of Rent Charge ( subject to variation as in the said Act provided and subject to the other provisions therein contained ) shall be payable and paid to the said Walter Augustus Shirley as vicar of the said Parish and to his Successors Owners of the tithes within the said township except the tithes of Corn Grain and Hay of eight and a half acres of land which belong to the said Robert Steeple as Lay Impropriator thereof

And that the Annual Sum of Ten Shillings by way of Rent Charge as aforesaid ( subject to variation as in the said Act provided and subject to the other provisions therein contained ) shall be payable and paid to the said Robert Steeple as Lay Impropriator his heirs and Asisgns instead of all the tithes as well great as small of the lands of the said township subject to tithes and all moduses and compositions seal and prescriptive and Customary payments payable in respect of such lands or the produce thereof

In testimony whereof the said parties to these presents or their respective agents thereunto duly authorised in their names and on their behalf have to these presents subscribed and set their respective hands and seals
